TERMS OF USE
1. Scope
These Terms of Use (hereinafter referred to as “ToU”) apply to the website https://www.thetransat.com/ (hereinafter collectively referred to as the “Digital Platform”).

These ToU apply to all persons accessing the Digital Platform (hereinafter the “User”).
2. Intellectual property rights
The Digital Platform and its content — including data, information, logos, trademarks, comments, works, texts, illustrations, images, etc. — are protected under French law, particularly under the provisions of the Intellectual Property Code, as well as international copyright conventions.
Any use, including copying, reproduction, representation, translation, adaptation, distribution, whether in whole or in part, of the content or information on the Digital Platform, in any form and by any means, is strictly prohibited without the prior written authorization of the Publisher (Article L. 122-4 of the French Intellectual Property Code).

Any use of the content of the Digital Platform is limited solely to the authorizations granted in Article 3 below.
3. Use of the Digital Platform without creating a user account
The Publisher grants the User, for private purposes, a temporary, revocable, non-transferable, non-assignable and non-exclusive license granting a limited right of use of the Digital Platform content under the following conditions:

View editorial content.

Partially save pages being consulted on a single personal computer or mobile device for single-screen display, as well as print a single copy on paper for strictly private use.
The Publisher authorizes the User to share content from the Digital Platform publicly:

Via the standard social media sharing tools available through the provided share buttons; or

By reproducing the article’s title, the first two lines, and creating a link to the original article.
In the event of non-compliance with Articles 2 and 3 of these ToU, and more broadly with the Intellectual Property Code, the Publisher reserves the right to seek compensation for any infringement of its copyrights, from any person, whether acting in good or bad faith. The Publisher also reserves the right to take legal action or make claims to prevent, stop, and penalize any unauthorized use of the Digital Platform.
4. Use of the Digital Platform with the creation of a user account
4.1. Creating a user account on the Digital Platform
Creating a user account is done online on the Digital Platform by providing personal information, choosing a login (valid email address), and creating a password.
4.2. General provisions on login and password
Use of the login and password is strictly personal and reserved for the Client only. The Client undertakes to choose a strong password and not disclose it.
The Client will be solely responsible for any disclosure of their password and for any use of their login by themselves or third parties. Any disclosure of the password by the Client will make them directly and fully liable for any damage resulting from such unauthorized use.
The Client may change their password at any time. This change will automatically invalidate their previous password.
In case of misuse or use of their login details by a third party, the Client agrees to notify the Publisher as soon as possible.
In case of non-compliance by the Client with these ToU, the Client’s access to the content and additional services of the Digital Platform may be immediately suspended or terminated without prior notice or formal warning.
The Publisher reserves the right to modify the Digital Platform and the conditions of access at any time, without the Client being able to object.
5. User’s responsibility
The User guarantees the Publisher that their use of the Digital Platform does not infringe the rights of third parties (e.g. right to privacy, defamation, image rights, copyright, etc.), public order, or public decency, and complies with these ToU.
6. Publisher’s responsibility
The Publisher takes great care in compiling and updating the information available on the Digital Platform and reserves the right to modify or correct its content at any time without notice.
The Publisher cannot guarantee uninterrupted service, data transmission times, or the security of information inherent to the Internet network, which the User acknowledges being familiar with and accepts the characteristics and limitations thereof. The User acknowledges, in particular, having ensured that the technical characteristics of their connection, equipment, and software allow them to access the service in good conditions.
It is also the User’s responsibility to take all appropriate measures to protect their own data, software, and/or equipment against potential viruses or other computer infections circulating on the Internet. The Publisher cannot, under any circumstances, be held liable for any contamination.
Consequently, the Publisher shall not be held liable for any direct or indirect damage resulting from the use of the Digital Platform or any information obtained through it.
Any use of the service by the User that directly or indirectly causes damage to the Publisher may give rise to a claim for compensation by the Publisher against the User.
7. Hyperlinks
The Digital Platform may contain links to partner sites or other websites/sources. The Publisher has no control over these sites and assumes no responsibility for their accessibility, content, advertising, products, or services available on or through these sites.
However, the Publisher reserves the right to remove from its Digital Platform any link to an external page containing content that may offend Users as soon as it becomes aware of it.

These ToU are governed by French law. In the event of a dispute, jurisdiction shall be determined according to the rules of common law.
